Buist, Byars & Taylor offers a comprehensive commercial real estate practice led by senior attorneys with a history of working with developers, lenders and contractors in various capacities. Attorneys work on projects that range from raw land acquisitions and sales to planned unit, mixed-use and condominium developments. The firm has significant experience with traditional neighborhood designs (TNDs).

Attorneys assist clients in all aspects of the development process. In early stages, attorneys negotiate and structure contracts, form and organize ownership entities, and review title, land use planning and regulatory issues.

Beyond basic due diligence, the firm's attorneys have significant experience in the review and negotiation of loan documents ranging from basic acquisition and development loans to more complex New Markets Tax Credit and Historic Tax Credit financing.

During actual development, attorneys routinely advise and represent clients on preparing contracts for the design and construction of buildings, negotiating and closing project financing, and negotiating and preparing leases. The firm also represents real estate lenders, including banks and insurance companies, in the preparation and management of loans and loan documents.

Once building projects are established, the firm may represent property owners' associations and provide assistance with covenant interpretation and enforcement issues. Our real estate litigation department handles litigation involving contract disputes, warranty and construction defects claims, liens of suppliers and subcontractors, zoning and disputes with homeowners associations.
