Hamlin O’Kelley recently tried to jury verdict in Charleston County involving a dispute between neighbors on Seabrook Island. He represented the Defendants, whom the Plaintiffs sued for trespass, intentional infliction of emotional distress, actual damages, and punitive damages. The Plaintiffs’ settlement demand before trial was over $200,000.
At the close the Plaintiffs’ case, Hamlin moved for a directed verdict on all causes of action. The Court granted the motion as to intentional infliction of emotional distress and punitive damages. The jury deliberated almost six hours before returning a verdict for nominal damages in the amount of only $1,000.
